SB 41 (BR 144) - D. Kelly
AN ACT relating to reorganization.
Create and amend various sections within the Kentucky Revised Statutes to establish the Environmental and Public Protection Cabinet and combine within the cabinet and the agencies the programs relating to natural resources and the environment, labor, and public protection; direct the consolidation of support offices for the programs within the cabinet; repeal 224.10-030, 224.10-055, and 224.10-060, relating to past actions; confirm Executive Order 2004-731, dated July 9, 2004.
SB 41 - AMENDMENTS
SCS - Retain original provisions of SB 41; add Division of Administrative Services to the Office of the Commissioner in the Department of Labor; exempt complaints and hearings associated with the Underground Petroleum Storage Tank Fund Program from KRS 13B.020; attach the Office of Workers' Claims administratively to the Department of Labor; attach the Kentucky Occupational Safety and Health Commission administratively to the Office of the Secretary; amend KRS 351 to include the executive director of the Office of Mine Safety and Licensing; authorize the Secretary rather than the Commissioner of Natural Resources to have authority to promulgate regulations under KRS Chapter 351; authorize the secretary to appoint a deputy to sign all final orders of the cabinet; transfer the Division of Energy to the Tourism Cabinet; make technical corrections; and renumber sections, subsections and paragraphs.
SFA (1, D. Kelly) - Restore authority of the Governor to appoint the Executive Director of the Office of Insurance subject to confirmation by the Senate; provide that the Executive Director may be reappointed.
SFA (2, D. Kelly) - Delete reference to KRS 342.228.
SFA (3, D. Kelly) - Delete reference to the Division of Energy.
SFA (4, D. Kelly) - Delete existing divisions listed in statute applicable to the former Department of Surface Mining Reclamation and Enforcement that no longer exist under the Department for Natural Resources.
HFA (1, J. Barrows) - Amend KRS 224.10-020 to require the director of the Division of Conservation to be appointed in accordance with KRS 146.100.
HFA (2, M. Cherry) - Make technical correction.
HFA (3, T. Thompson) - Amend KRS 304.17B-021 to delete the second assessment for funding of Guaranteed Acceptance Program losses and Kentucky Access.
HFA (4/Title, T. Thompson) - Make title amendment.
HFA (5, M. Cherry) - Amend KRS 229.031 to prohibit the application of a 5% tax on the gross receipts on the sale, lease or exploitation of broadcasting, television, and motion picture rights of professional boxing and wrestling matches or exhibitions.
HFA (6/Title, M. Cherry) - Make title amendment.
